# Did the insurer prove that the amount billed exceeded the applicable workers’ compensation fee schedule?

A decision decides this question when it rules on the merits of an insurer's defense (or an insurer's own claim, e.g. in a de novo action or declaratory action) that a provider's charges exceed what the fee schedules allow (Insurance Law § 5108; 11 NYCRR Part 68), and says whether the insurer's proof established that excess. That includes disputes over the calculation itself (codes, relative values, conversion factors, ground rules, bundling, unit limits) and over which schedule or rate governs (licensed acupuncturists at the chiropractor or physician rate, the New Jersey schedule for out-of-state services under 11 NYCRR 68.6, the DME 150%-of-cost rule, OBS facility fees). Typical rulings: a coder's or examiner's affidavit explaining the calculation was or was not enough; the insurer failed to establish the defense as a matter of law; after trial the insurer did or did not prove its calculation.

- Status: Settled at the Appellate Division, no conflicting department. No Court of Appeals decision states what proof the insurer needs; Government Empls. Ins. Co. v Avanguard (2016) decides only that OBS facility fees are not payable under the schedules. The working rule comes from the Appellate Terms and is applied without disagreement by the Second and First Departments: the insurer bears the burden; a timely denial alone, or a conclusory statement that the claim underwent a 'fee schedule review', is not enough; an affidavit of a certified coder or trained claims examiner explaining the codes, relative values, conversion factor and ground rules, with the schedule annexed or judicially noticed, establishes the defense prima facie; a provider's opposition by counsel's affirmation alone does not raise an issue. Courts differ only at the edges: the rate for licensed acupuncturists (Appellate Term, Second Department treats the chiropractor schedule as correct as a matter of law; the First Department in Global Liberty v Acupuncture Now (2019) held that this does not foreclose the physician schedule in every case) and whether a non-certified examiner suffices.

## Leading authorities

- [Allstate Ins. Co. v Buffalo Neurosurgery Group (2019 NY Slip Op 03749)](https://www.beynensonlaw.com/case-law/allstate-ins-co-v-buffalo-neurosurgery-group-2019-ny-slip-op-03749/) — Appellate Division, Second Department, 2019. Second Department: insurer's fee schedule showing established excess, unrebutted: In the insurer's de novo action under Insurance Law § 5106 (c), the insurer established prima facie that the amount the provider sought was not in accordance with the workers' compensation fee schedule, and the provider failed to raise a triable issue; summary judgment on that branch should have been granted.
- [Global Liberty Ins. Co. of N.Y. v Acupuncture Now, P.C. (2019 NY Slip Op 08942)](https://www.beynensonlaw.com/case-law/global-liberty-ins-co-of-n-y-v-acupuncture-now-p-c-2019-ny-slip-op08942/) — Appellate Division, First Department, 2019. First Department: chiropractor rate not mandatory for every licensed acupuncturist: Insurers seeking a declaration that licensed acupuncturists may be paid only under the chiropractor schedule did not show that as a matter of law or that the claims exceeded the schedule, and the providers raised an issue of fact whether the physician schedule applies; Great Wall-type holdings do not foreclose the physician schedule in all cases.
- [Rogy Med., P.C. v Mercury Cas. Co. (2009 NY Slip Op 50732(U))](https://www.beynensonlaw.com/case-law/rogy-med-p-c-v-mercury-cas-co-2009-ny-slip-op-50732u/) — Appellate Term, Second Department, 2009. Insurer must prove the excess; a timely denial is not enough: The insurer showed it timely denied the claims on the fee schedule ground but did not submit sufficient evidence that the amounts charged exceeded the fee schedule, so the denial of its summary judgment motion was affirmed.
- [Great Wall Acupuncture, P.C. v Geico Ins. Co. (2009 NY Slip Op 29467)](https://www.beynensonlaw.com/case-law/great-wall-acupuncture-p-c-v-geico-ins-co-2009-ny-slip-op-29467/) — Appellate Term, Second Department, 2009. Licensed acupuncturists may be paid at the chiropractor acupuncture rate: After a nonjury trial on stipulated facts, the court held as a matter of law that an insurer may use the workers' compensation fee schedule for acupuncture by chiropractors to pay a licensed acupuncturist; since the insurer had paid at that rate, no further reimbursement was due.
- [Oleg’s Acupuncture, P.C. v Hereford Ins. Co. (2018 NY Slip Op 50095(U))](https://www.beynensonlaw.com/case-law/olegs-acupuncture-p-c-v-hereford-ins-co-2018-ny-slip-op-50095u/) — Appellate Term, Second Department, 2018. Certified coder's affidavit suffices; counsel's affirmation cannot rebut it: A certified medical coder's affidavit established prima facie that the insurer had fully paid the claims under the fee schedule; the provider's attorney affirmation raised no triable issue, and for services after April 1, 2013 no timely denial was needed, so the complaint was dismissed.
- [MIA Acupuncture, P.C. v Praetorian Ins. Co. (2011 NY Slip Op 21480)](https://www.beynensonlaw.com/case-law/mia-acupuncture-p-c-v-praetorian-ins-co-2011-ny-slip-op-21480/) — Appellate Term, Second Department, 2011. Conclusory 'fee schedule review' statement does not prove the excess: A claims examiner's statement that the claims underwent a 'fee schedule review' resulting in a reduction did not establish that the charges exceeded the workers' compensation fee schedule, so the insurer was not entitled to summary judgment on those claims.
- Kingsbrook Jewish Med. Ctr. v Allstate Ins. Co., 61 AD3d 13 (not in the database). Cited by 23 candidates: the workers' compensation fee schedule may be judicially noticed (used to decide whether the schedule must be annexed), and Rogy cites it for the insurer's burden; it also held that a fee schedule defense is precluded if not timely raised (pre-2013 precludability, outside this topic).

## Categories

- **Excess shown**: For every fee-schedule-disputed charge the court rules on, the court holds that the insurer established (as a matter of law on a motion, or as the finding after a trial, or by upholding such a ruling or award) that the charges exceed the amount the applicable schedule permits, or that the insurer's reduced payment was the full scheduled amount, so nothing more is due on those charges.
- **Not established; open**: The court holds that the insurer did not establish the fee schedule defense as a matter of law, or that a triable issue of fact exists on the calculation or on which schedule applies, and the question stays open (insurer's motion denied; provider's motion denied because the insurer's fee schedule showing raised an issue; vacatur and remand to an arbitrator to consider fee schedule evidence).
- **Defense rejected**: The court finally rejects the insurer's fee schedule position for the disputed charges: after a trial the insurer failed to prove its calculation; the court holds as a matter of law that the insurer's reading of the schedule, code or rate is wrong; or the insurer's proof is held insufficient and the provider is awarded the disputed amount (including on a search of the record or because the insurer's own coder concedes the amount is owed).
- **Split by charge**: Within one decision the court reaches different results on different fee-schedule-disputed charges or codes (e.g. excess shown for CPT 97810/97811 but not for the 99203 initial visit; recoding upheld but Ground Rule 11 reduction not shown).

### Appellate Division, First Department

- [Global Liberty Ins. Co. of N.Y. v Acupuncture Now, P.C. (2019 NY Slip Op 08942)](https://www.beynensonlaw.com/case-law/global-liberty-ins-co-of-n-y-v-acupuncture-now-p-c-2019-ny-slip-op08942/) — Appellate Division, First Department, 2019-12-12 — Not established; open [central]: Held the insurers did not show as a matter of law that licensed acupuncturists may be paid only at the chiropractor rate or that the claims exceeded the schedule, and the providers raised an issue whether the physician schedule applies.
- [Matter of Global Liberty Ins. Co. v McMahon (2019 NY Slip Op 03692)](https://www.beynensonlaw.com/case-law/matter-of-global-liberty-ins-co-v-mcmahon-2019-ny-slip-op-03692/) — Appellate Division, First Department, 2019-05-09 — Not established; open [central]: Vacated the award and remanded because the arbitrator wrongly refused to consider CPT Assistant, which is incorporated by reference into the workers' compensation fee schedule through the CPT book.

(2022 NY Slip Op 02252)](https://www.beynensonlaw.com/case-law/healthplus-surgery-ctr-llc-v-american-tr-ins-co-2022-ny-slip-op02252/) — Appellate Division, Second Department, 2022-04-06 — Excess shown [central]: Held the insurer's expert affidavit established that the bills exceeded the applicable fee schedule, limiting recovery to the calculated amounts, and the provider raised no triable issue, so the excess was dismissed.
- [Healthplus Surgery Ctr., LLC v Global Liberty Ins. Co. of N.Y. (2020 NY Slip Op 03772)](https://www.beynensonlaw.com/case-law/healthplus-surgery-ctr-llc-v-global-liberty-ins-co-of-n-y-2020-ny-slip-op03772/) — Appellate Division, Second Department, 2020-07-08 — Not established; open [central]: Held that although the insurer showed the surgical device was not reimbursable under the applicable New Jersey fee schedule, the provider raised a triable issue whether the device qualified for reimbursement under the New Jersey code.
- [Matter of Hereford Ins. Co. v American Tr. Ins. Co. (2019 NY Slip Op 05778)](https://www.beynensonlaw.com/case-law/matter-of-hereford-ins-co-v-american-tr-ins-co-2019-ny-slip-op05778/) — Appellate Division, Second Department, 2019-07-24 — Defense rejected [also decides]: Confirmed a loss-transfer award granting full recovery despite the respondent insurer's fee schedule challenge to New Jersey services, finding the award had a reasonable hypothesis and was not arbitrary and capricious.
- [Allstate Ins. Co. v Buffalo Neurosurgery Group (2019 NY Slip Op 03749)](https://www.beynensonlaw.com/case-law/allstate-ins-co-v-buffalo-neurosurgery-group-2019-ny-slip-op-03749/) — Appellate Division, Second Department, 2019-05-15 — Excess shown [central]: In the insurer's de novo action, held it established that the benefits sought were not in accordance with the fee schedule and the provider failed to raise a triable issue, so summary judgment on that branch was granted.
- [Government Empls. Ins. Co. v Avanguard Med. Group, PLLC (2015 NY Slip Op 01413)](https://www.beynensonlaw.com/case-law/government-empls-ins-co-v-avanguard-med-group-pllc-2015-ny-slip-op-01413/) — Appellate Division, Second Department, 2015-02-18 — Excess shown [also decides]: Held the insurer not required to pay facility fees for office-based surgery because no applicable fee schedule provides for them and the 11 NYCRR 68.5 default provision cannot create a new category of reimbursable fees.
- [Forrest Chen Acupuncture Servs., P.C. v GEICO Ins. Co. (2008 NY Slip Op 07211)](https://www.beynensonlaw.com/case-law/forrest-chen-acupuncture-servs-p-c-v-geico-ins-co-2008-ny-slip-op07211/) — Appellate Division, Second Department, 2008-09-30 — Excess shown [central]: Held the insurer established that no acupuncture fee schedule existed in 2001 and that it properly limited payment to charges for similar procedures under existing schedules, and the provider raised no issue of fact.

- [Atlantic Med. & Diagnostic, P.C. v State Farm Mut. Auto. Ins. Co. (2024 NY Slip Op 51785(U))](https://www.beynensonlaw.com/case-law/atlantic-med-diagnostic-p-c-v-state-farm-mut-auto-ins-co-2024-ny-slip-op-51785u/) — District Court of Suffolk County, Third District, 2024-12-12 — Defense rejected [central]: Held after trial that the fee schedule itself, including Radiology Ground Rule 3, permits billing multiple units of ultrasound guidance with trigger point injections, rejecting the insurer's coder's reliance on AMA guidance.
- [Advanced Recovery Equip. & Supplies v Travelers Ins. Co. (2022 NY Slip Op 50690(U))](https://www.beynensonlaw.com/case-law/advanced-recovery-equip-supplies-v-travelers-ins-co-2022-ny-slip-op50690u/) — Civil Court of the City of New York, Queens County, 2022-07-21 — Not established; open [central]: Held the insurer failed to establish the fee schedule defense because its medical appeals analyst did not state qualifications showing she was an expert able to interpret the fee schedule.
- [SB Chiropractic, P.C. v GEICO Ins. Co. (2022 NY Slip Op 50316(U))](https://www.beynensonlaw.com/case-law/sb-chiropractic-p-c-v-geico-ins-co-2022-ny-slip-op-50316u/) — Civil Court of the City of New York, Kings County, 2022-04-20 — Excess shown [central]: Held the insurer's affidavit and affirmation properly applied fee schedule ground-rule RVU caps and prior payments to another provider, and the provider's rebuttal affidavit addressed codes not billed, so the reductions were proper.
- [Demas v State Farm Fire & Cas. Co. (2022 NY Slip Op 50250(U))](https://www.beynensonlaw.com/case-law/demas-v-state-farm-fire-cas-co-2022-ny-slip-op-50250u/) — Civil Court of the City of New York, Kings County, 2022-04-06 — Not established; open [central]: Held the coder's downcoding of cupping and borrowed relative value rested on an unauthoritative source and unreliable hearsay, so the insurer failed to establish proper fee schedule payment as a matter of law.
- [Optimum Health Acupuncture, P.C. v Integon Natl. Ins. Co. (2022 NY Slip Op 50068(U))](https://www.beynensonlaw.com/case-law/optimum-health-acupuncture-p-c-v-integon-natl-ins-co-2022-ny-slip-op50068u/) — District Court of Suffolk County, Fourth District, 2022-01-05 — Excess shown [central]: Held the certified coder's affidavit established the billing exceeded the fee schedule, and the provider's missing coder affidavit left only an attorney's opposition without personal knowledge, raising no triable issue.
- [New York Med. & Diagnostic Ctr. v GEICO Ins. Co. - [Medalliance Med. Health Servs. v Travelers Prop. Cas. Ins. Co. (2021 NY Slip Op 50737(U))](https://www.beynensonlaw.com/case-law/medalliance-med-health-servs-v-travelers-prop-cas-ins-co-2021-ny-slip-op50737u/) — District Court of Suffolk County, Fourth District, 2021-06-30 — Not established; open [central]: Held the insurer failed to establish its fee schedule defense because it offered no coder or claim representative affidavit explaining the relative values and conversion factors applied, and its PPO-rate reductions were not shown applicable.

- [Tyorkin v Garrison Prop. & Cas. Ins. Co. (2016 NY Slip Op 50846(U))](https://www.beynensonlaw.com/case-law/tyorkin-v-garrison-prop-cas-ins-co-2016-ny-slip-op50846u/) — Civil Court of the City of New York, Kings County, 2016-05-20 — Not established; open [central]: Held the New Jersey schedule governed and the defense was not precludable, but the coder's unexplained calculation only raised a triable issue and could not support summary judgment, so the fee schedule defense went to trial.
- [East Coast Acupuncture, P.C. v Hereford Ins. Co. (2016 NY Slip Op 26042)](https://www.beynensonlaw.com/case-law/east-coast-acupuncture-p-c-v-hereford-ins-co-2016-ny-slip-op-26042/) — Civil Court of the City of New York, Kings County, 2016-02-09 — Excess shown [central]: Held, on the unopposed affidavit of a certified coder explaining the calculation and copies of checks, that the insurer had paid the acupuncturist at the chiropractor rate in accordance with the fee schedule, so nothing more was owed.

- [Allstate Ins. Co. v Natural Healing Acupuncture, P.C. (2013 NY Slip Op 50645(U))](https://www.beynensonlaw.com/case-law/allstate-ins-co-v-natural-healing-acupuncture-p-c-2013-ny-slip-op50645u/) — Civil Court of the City of New York, Kings County, 2013-04-03 — Not established; open [central]: Vacated the master arbitrator's award applying the physician acupuncture rate as contrary to settled law and directed recalculation of the licensed acupuncturist's fees under the chiropractor acupuncture schedule.

- [Custis v Travelers Prop. Cas. Ins. Co. (2010 NY Slip Op 20118)](https://www.beynensonlaw.com/case-law/custis-v-travelers-prop-cas-ins-co-2010-ny-slip-op-20118/) — District Court of Suffolk County, Third District, 2010-04-07 — Split by charge [central]: Held the insurer showed its Ground Rule 11 reductions, the disallowed new-patient visit codes and the 99213 recalculation were correct, but its coder's conclusory recoding of 99244 and 99214 claims did not establish proper payment.
- [Jesa Med. Supply, Inc. v GEICO Ins. Co. (2009 NY Slip Op 29386)](https://www.beynensonlaw.com/case-law/jesa-med-supply-inc-v-geico-ins-co-2009-ny-slip-op-29386/) — Civil Court of the City of New York, Kings County, 2009-09-22 — Defense rejected [central]: Held the insurer's affidavit did not explain how the fee schedule was applied or how the charge exceeded it, so the provider was granted summary judgment for the reduced balance.

(2008 NY Slip Op 28275)](https://www.beynensonlaw.com/case-law/lenox-hill-radiology-v-new-york-cent-mut-fire-ins-co-2008-ny-slip-op-28275/) — District Court of Nassau County, First District, 2008-07-25 — Not established; open [central]: Held the insurer failed to establish that MRI charges exceeded the fee schedule because it relied only on counsel's affirmation, a conclusory examiner statement and a non-binding federal decision applying the X-ray multiple-procedure rule.
- [St. Vincent's Hosp. of Richmond v State Farm Mut. Auto. Ins. Co. (2007 NY Slip Op 52534(U))](https://www.beynensonlaw.com/case-law/st-vincents-hosp-of-richmond-v-state-farm-mut-auto-ins-co-2007-ny-slip-op52534u/) — Supreme Court, Nassau County, 2007-12-31 — Not established; open [central]: Held a question of fact existed whether the hospital's charges exceeded the workers' compensation fee schedule despite the timely partial denial, so both motions were denied and a hearing ordered on the amount due.

(2006 NY Slip Op 26240)](https://www.beynensonlaw.com/case-law/robert-physical-therapy-p-c-v-state-farm-mut-auto-ins-co-2006-ny-slip-op-26240/) — Civil Court, Kings County, 2006-06-21 — Defense rejected [central]: Held a physical therapist could bill range-of-motion and muscle-testing codes from the medicine section, and the insurer offered no competent proof that those tests were bundled into evaluation services, so the provider recovered the disputed amounts.
- [Roberts Physical Therapy, P.C. v State Farm Mut. Auto Ins. Co. (2006 NY Slip Op 52565(U))](https://www.beynensonlaw.com/case-law/roberts-physical-therapy-p-c-v-state-farm-mut-auto-ins-co-2006-ny-slip-op-52565u/) — Civil Court of the City of New York, Kings County, 2006-05-30 — Defense rejected [central]: Held after trial that the range-of-motion and muscle-testing codes were listed in the schedule and billed at the proper physical therapist rate, and the insurer offered no contrary proof.

- [Macintosh Med., P.C. v State Farm Mut. Auto Insur. Co. (2005 NY Slip Op 51440(U))](https://www.beynensonlaw.com/case-law/macintosh-med-p-c-v-state-farm-mut-auto-insur-co-2005-ny-slip-op-51440u/) — District Court of Nassau County, Third District, 2005-09-13 — Excess shown [also decides]: Held the provider lacked a meritorious claim because the workers' compensation fee schedule reimburses physical medicine only when performed by physicians or licensed therapists, not licensed massage therapists.
- [Great Wall Acupuncture, P.C. v GEICO Gen. Ins. Co. (2005 NY Slip Op 51199(U))](https://www.beynensonlaw.com/case-law/great-wall-acupuncture-p-c-v-geico-gen-ins-co-2005-ny-slip-op-51199u/) — Civil Court of the City of New York, Kings County, 2005-07-28 — Not established; open [central]: Held whether a licensed acupuncturist's treatment is similar to chiropractic acupuncture, so as to justify the insurer's reduction to the chiropractor rate, was a triable fact issue, and counsel's affirmation could not show a higher prevailing fee.

(2004 NY Slip Op 51847(U))](https://www.beynensonlaw.com/case-law/a-b-med-servs-pllc-v-new-york-cent-mut-fire-ins-co-2004-ny-slip-op-51847u/) — Civil Court of the City of New York, Kings County, 2004-11-10 — Defense rejected [also decides]: Held the insurer submitted no evidentiary proof that the charges for medical supplies exceeded the 150%-of-cost fee schedule limit, and awarded the providers the full amount, the defense also being precluded by the untimely denial.
