# Does an insurer’s no-coverage declaratory judgment, or pending declaratory action, bar or stay a no-fault claimant’s action?

Covers decisions that rule on what an insurer's declaratory judgment (DJ) action does to a separate claim for the same benefits: whether a DJ or order declaring that the insurer owes no benefits for an accident, claimant or set of bills precludes (res judicata or collateral estoppel) the provider's (or injured person's) pending or later Civil/District Court action, arbitration, or judgment, in whole or in part; and whether that action should be stayed, enjoined or adjourned while the DJ action is pending. Deciding the question means the court actually applies or refuses to apply the DJ (or the pending DJ action) to the claims before it, for example on a motion for summary judgment, a CPLR 3211 (a) (5) motion, a motion to vacate a default (DJ offered as the meritorious defense), a motion to vacate a judgment or award, or a motion to stay. 'Action' includes no-fault arbitration and UM/SUM arbitration, and enforcement of a judgment already entered. It also covers a claimant's reliance on a ruling made in the insurer's DJ action.

- Status: Settled at the Appellate Division, no conflicting department. No Court of Appeals no-fault decision; the courts apply the Court of Appeals' general preclusion rules (Schuylkill Fuel: no second judgment that would destroy or impair rights established by the first; Gramatan: an assignee is bound only if the action against the assignor began before the assignment; Kaufman v Eli Lilly: a default is not 'actually litigated' for collateral estoppel). Both Appellate Terms apply these rules the same way: an unvacated DJ, including a default DJ, that declares no duty to pay a named provider (or its assignor when the assignment came after the DJ action began) bars the provider's action by res judicata; a provider not named, or whose assignment predates the DJ action, is not bound; an order that makes no declaration, or a DJ that does not cover the accident or claims, has no preclusive effect. The Second Department Appellate Division (Hereford v Shelly, 2025) applies res judicata to an unvacated default DJ to stay a later arbitration by claimants who were parties. Decisions differ in outcomes, not in the rule. The one point of internal nuance is collateral estoppel after a default: available only if the provider appeared in the DJ action (Parisien v Kemper, 2022; Nasrinpay, 2024), while res judicata applies to a default DJ regardless.

## Leading authorities

- [Matter of Hereford Ins. Co. v Shelly (2025 NY Slip Op 05681)](https://www.beynensonlaw.com/case-law/matter-of-hereford-ins-co-v-shelly-2025-ny-slip-op-05681/) — Appellate Division, Second Department, 2025. Unvacated default DJ is res judicata against claimants who were parties: A default declaratory judgment declaring that the insurer had no duty to pay claims from the accident and was entitled to a permanent stay of arbitrations barred, by res judicata, the claimants' later demand for (uninsured motorist) arbitration; the permanent stay was properly granted.
- [EBM Med. Health Care, P.C. v Republic W. Ins. (2012 NY Slip Op 22300)](https://www.beynensonlaw.com/case-law/ebm-med-health-care-p-c-v-republic-w-ins-2012-ny-slip-op-22300/) — Appellate Term, Second Department, 2012. Default DJ bars the named provider's pending action (res judicata): After the provider sued in Civil Court, the insurer obtained a default DJ declaring the provider not properly licensed and that the insurer owed it no benefits 'arising out of any current or future proceeding'. The pending action was a 'current' proceeding, so it was barred by res judicata; the Civil Court's denial of the insurer's summary judgment motion was reversed.
- [Magic Recovery Med. & Surgical Supply Inc. v State Farm Mut. Auto. Ins. Co. (2010 NY Slip Op 20130)](https://www.beynensonlaw.com/case-law/magic-recovery-med-surgical-supply-inc-v-state-farm-mut-auto-ins-co-2010-ny-slip-op-20130/) — Appellate Term, Second Department, 2010. Provider not named and not in privity is not bound: Default DJs absolving the insurer as to staged incidents did not bind a provider that was not named or served and whose assignments predated the DJ actions; and a default DJ has no collateral estoppel effect because nothing was actually litigated. Golia, J.P., dissented.
- [Metro Health Prods., Inc. v Nationwide Ins. (2015 NY Slip Op 25203)](https://www.beynensonlaw.com/case-law/metro-health-prods-inc-v-nationwide-ins-2015-ny-slip-op-25203/) — Appellate Term, Second Department, 2015. Order granting default without a declaration has no preclusive effect: A Supreme Court order granting the insurer's unopposed default motion and directing it to settle a judgment on notice made no declaration of the parties' rights, so it was not a conclusive final determination and did not bar the provider's action.
- [Pomona Med. Diagnostics, P.C. v Metropolitan Cas. Ins. Co. (2010 NY Slip Op 52039(U))](https://www.beynensonlaw.com/case-law/pomona-med-diagnostics-p-c-v-metropolitan-cas-ins-co-2010-ny-slip-op52039u/) — Appellate Term, First Department, 2010. First Department: default DJ against provider bars its action: A Supreme Court judgment, entered on the provider's default, declaring that the insurer may deny all claims from the assignor's accident barred the provider's actions by res judicata; the insurer's summary judgment motions should have been granted.
- [Compas Med., P.C. v Geico Ins. Co. (2013 NY Slip Op 52016(U))](https://www.beynensonlaw.com/case-law/compas-med-p-c-v-geico-ins-co-2013-ny-slip-op-52016u/) — Appellate Term, Second Department, 2013. Civil Court may stay provider action pending insurer's DJ action: The Civil Court did not improvidently exercise its CPLR 2201 discretion in staying a provider's action pending final determination of the insurer's Supreme Court declaratory judgment action, in which the provider and its assignor were named defendants.
- Gramatan Home Invs. Corp. v Lopez, 46 NY2d 481 (not in the database). Assignee is in privity with (and bound by a judgment against) its assignor only if the action against the assignor was commenced before the assignment; basis of the non-party limit.
- Schuylkill Fuel Corp. v Nieberg Realty Corp., 250 NY 304, 306-307 (not in the database). Res judicata applies where a different judgment in the second action would destroy or impair rights established by the first; quoted in nearly every 'barred' decision.
- Kaufman v Eli Lilly & Co., 65 NY2d 449, 456-457 (not in the database). An issue is not actually litigated where there has been a default; limits collateral estoppel (not res judicata) from default DJs.
- Matter of Hunter, 4 NY3d 260, 269 (not in the database). General transactional res judicata rule cited by the Appellate Terms.
- Hirsch v Lindor Realty Corp., 63 NY2d 878, 881 (not in the database). A court deciding a DJ action must make a declaration of the parties' rights; basis of the 'no declaration, no preclusion' limit.
- Lazides v P & G Enters., 58 AD3d 607 (not in the database). Res judicata applies to an unvacated default judgment; cited for default DJs.
- Matter of Eagle Ins. Co. v Facey, 272 AD2d 399 (not in the database). Default judgment has res judicata effect; cited in EBM and Ava.
- Chestnut Hill Real Estate v Contractors Cas. & Sur. Co., 280 AD2d 446 (not in the database). Relief from a judgment may only be sought from the court that rendered it; why a Supreme Court DJ cannot vacate a Civil Court judgment (Master Cheng, Bronx Med. Diagnostic).
- Trisingh Enters., Inc. v Kessler, 249 AD2d 45 (not in the database). First Department authority that res judicata applies to an unvacated default judgment (cited in Pomona).
- State Farm Mut. Auto. Ins. Co. v Anikeyeva, 130 AD3d 1007 (not in the database). Affirmed a default DJ that PCs were unlawfully incorporated; not in the database (the 2011 and 2021 Anikeyeva decisions are).

## Categories

- **Barred by DJ**: The court holds that the DJ (or order in the DJ action) precludes the claimant's action, arbitration or judgment: the complaint is dismissed or summary judgment is granted to the insurer under res judicata or collateral estoppel, the claimant's motion is denied because of the DJ, the action or arbitration is permanently stayed on the strength of the DJ, or the DJ is held to be a meritorious defense supporting vacatur of the claimant's default judgment. Includes holdings that a default DJ is a conclusive final determination, that a pending action is a 'current' proceeding within the DJ's terms, and decisions taking judicial notice of the DJ on appeal and dismissing on that basis.
- **Barred in part**: The court applies the DJ to some bills, dates of service, assignors or causes of action and expressly holds that other claims in the same action fall outside it (e.g. a bill not listed in the DJ's schedule, an assignor not covered, a separate claim for interest and attorney's fees), so the action survives as to those.
- **Not bound: parties**: The court refuses preclusion because the identity-of-parties element fails: the provider was not named or served in the DJ action; the provider is not in privity with its named assignor because the assignment was made before the DJ action was commenced (Gramatan); the provider never appeared, so a default DJ cannot have collateral estoppel effect for lack of a full and fair opportunity to litigate; or the insurer relying on the DJ was not shown to be the DJ plaintiff or in privity with it (different corporate entity, different claim number).
- **DJ does not reach**: The court refuses preclusion for a reason about the DJ itself: it covers a different accident date, claim, assignor or time period, or only future/past actions; the order merely grants a default motion or directs settlement of a judgment without declaring the parties' rights; the ruling is not a final determination on the merits (e.g. denial of summary judgment in the DJ action); the DJ was vacated, was issued by a court without subject-matter jurisdiction (Civil Court DJ, CCA 212-a), or is a sister-state default not entitled to recognition; the insurer failed to prove the DJ's terms or that the services are within it; or the DJ cannot vacate or undo a judgment already entered or an arbitration award already rendered.
- **Stayed pending DJ**: No final DJ governs yet, and the court stays the no-fault action (CPLR 2201), enjoins pending or future suits or arbitrations, upholds such a stay, or stays the action to let the claimant move to vacate a default DJ, pending the outcome of the DJ action. Includes a DJ court's preliminary injunction against the claimant's collection suits pending determination.
- **Stay denied**: The court refuses to stay or adjourn the claimant's action pending the insurer's DJ action, vacates such a stay, or holds that an interim stay or injunction issued in the DJ action does not affect the claimant's action or judgment (e.g. it was entered after the claimant's judgment, or ended when the DJ was entered without a disposition against the claimant).

- [State Farm Mut. Auto. Ins. Co. v Anikeyeva (2021 NY Slip Op 04728)](https://www.beynensonlaw.com/case-law/state-farm-mut-auto-ins-co-v-anikeyeva-2021-ny-slip-op-04728/) — Appellate Division, Second Department, 2021-08-18 — Stayed pending DJ [central]: Upheld a preliminary injunction in the insurer's declaratory action restraining enforcement of the provider's earlier Civil Court judgment, because the judgment was obtained as part of a larger fraudulent scheme.

(2013 NY Slip Op 23068)](https://www.beynensonlaw.com/case-law/ideal-med-supply-v-mercury-cas-ins-co-2013-ny-slip-op-23068/) — Appellate Term, First Department, 2013-03-12 — Not bound: parties [central]: Held the provider was not bound by the Supreme Court declaration because it was not a party to the declaratory action, and was not in privity with its named assignor since the assignment predated that action.

Co. v Romero-Richiez (2020 NY Slip Op 51181(U))](https://www.beynensonlaw.com/case-law/american-tr-ins-co-v-romero-richiez-2020-ny-slip-op-51181u/) — Supreme Court, New York County, 2020-10-09 — Not bound: parties [also decides]: Held that the default declaration against the assignor did not bind the provider assignee, because an assignment made before the action is not barred by a default against the assignor.

- [Tristate Multi-Specialty Med. Servs., P.C. v Progressive Cas. Ins. Co. (2026 NY Slip Op 50340(U))](https://www.beynensonlaw.com/case-law/tristate-multi-specialty-med-servs-p-c-v-progressive-cas-ins-co-2026-ny-slip-op-50340u/) — Civil Court of the City of New York, Kings County, 2026-03-17 — Barred by DJ [central]: Granted the insurer a directed verdict dismissing the provider's action because a Supreme Court staged-accident declaratory judgment barred payment to the provider for the incident, rejecting the bid for judgment in the non-party assignor's favor.

(2026 NY Slip Op 50343(U))](https://www.beynensonlaw.com/case-law/reactive-physical-therapy-p-c-v-progressive-cas-ins-co-2026-ny-slip-op-50343u/) — Civil Court of the City of New York, Kings County, 2026-03-17 — Barred by DJ [central]: Granted the insurer a directed verdict dismissing the provider's action because a Supreme Court staged-accident declaratory judgment barred payment to the provider for the incident, rejecting the bid for judgment in the non-party assignor's favor.

(2024 NY Slip Op 50276(U))](https://www.beynensonlaw.com/case-law/primavera-physical-therapy-p-c-v-state-farm-ins-co-2024-ny-slip-op-50276u/) — Civil Court of the City of New York, Kings County, 2024-03-05 — Barred by DJ [central]: Dismissed the provider's action under res judicata and collateral estoppel because a default Supreme Court declaratory judgment covering the same parties and accident declared no right to payment, despite the absence of a claim number.

(2021 NY Slip Op 50869(U))](https://www.beynensonlaw.com/case-law/tandingan-pt-pc-v-state-farm-fire-cas-co-2021-ny-slip-op-50869u/) — Civil Court of the City of New York, Queens County, 2021-09-16 — Barred by DJ [central]: Held that the Supreme Court inquest order declaring no obligation to pay the claims listed in its exhibit, for EUO no-shows, barred by res judicata the three claims this action shared with that list.

- [Bronx Chiropractic Rehabilitation, P.C. v Progressive Ins. Co. (2020 NY Slip Op 20275)](https://www.beynensonlaw.com/case-law/bronx-chiropractic-rehabilitation-p-c-v-progressive-ins-co-2020-ny-slip-op-20275/) — Civil Court of the City of New York, Kings County, 2020-10-20 — Barred by DJ [central]: Held the provider's action barred by res judicata and collateral estoppel by a declaratory judgment voiding the policy, because the insurer proved the DJ plaintiff was the true insurer and the misnamed defendant was amended accordingly.
